Murder, She Wrote...
So what makes for murder and what makes for manslaughter and what makes
for just plain accident ? Heat-of-the-moment vs premeditated ? Degree of
cruelty ? Need to set an example ? Number of people killed ? LA Times has
an interesting commentary
by a Law Prof about the gray area between murder, manslaughter, and
accident. I hadn't realized that they haven't yet charged the 86 year old
guy who mowed down about 10 people in the Santa Monica market.
When the David Westerfield trial happened in San Diego, I had just moved to SD. I'm not sure if Westerfield
would have been sentenced to death had there not been so much media
coverage. Trial by media has become a real pain.
